Permit me to express an observation.
We are what we are. We are the sovereigns. There is no need to imagine we are sovereigns we just are. We are what we are by virtue of our being able to state we are!
We need to be so confident in who we are that we will have convinced anyone to whom it matters, we are the sovereigns. That it would not be in their best interests to challenge our sovereignty.
We do that by knowing who and what we are. That means no wishy-washy attitudes. No indecision. No waiting for someone else to carry our water. No waiting for further instructions to act from the creator (for those who truly believe…he is with us all of the time and in constant communication).
It means we are not bound by historical references. History is mostly heresay…it can be written to conform to support lies and deceit. People with self-respect and confidence know who and what they are. They need not be constrained by what others may claim. We may consider events in the past but not totally rely on them when deciding our future.
We are here right now. We are the only lawful authority. We are the ultimate authority. There is nothing about which to negotiate. There is noting to discuss. We are not here to be nice. We are not here to be loved. We are sovereigns…plain and simple. We are responsible. We make the decisions. All of the decisions.
There are no options as to your participation. You breathe the air and partake of the resources of the planet then you are involved. No excuses are acceptable.
So for one last time…if you have doubts…go arrange your sock drawer then return and consider your behavior as an equal participating member of this society. No one speaks for you like you. At that you are the expert.
Now act the part the creator had intended for you!
The people are the creators of the government. Read the Preambles of the state and federal Constitutions. The people are the source of all power in the gov’t. A people (not citizens) is not accountable to the gov’t. He is only accountable to other people, when he injures another people. [Note: the word “people” is both plural and singular. The plural of “person” is “persons”, not “people”.]
Relative to other people, a people is a peer. Relative to the creation of the people, i.e., the gov’t, he is sovereign.
California Government Code (instructions to the gov’t) Section 100 recognizes the Preamble’s premise: ” (a) The sovereignty of the state resides in the people thereof, and all writs and processes shall issue in their name. (b) The style of all process shall be “The People of the State of California,” and all prosecutions shall be conducted in their name and by their authority.” The state has no sovereignty outside its sphere of control. Any exercise of sovereignty is relative to the citizens, not the people of the state.
Calif. Gov. Code Section 11120.
“It is the public policy of this state that public agencies exist to aid in the conduct of the people’s business and the proceedings of public agencies be conducted openly so that the public may remain informed.
“In enacting this article the Legislature finds and declares that it is the intent of the law that actions of state agencies be taken openly and that their deliberation be conducted openly.
“The people of this state do not yield their sovereignty to the agencies which serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may retain control over the instruments they have created.”
“Sovereignty itself is, of course, not subject to law, for it is the author and source of law; but in our system, while sovereign powers are delegated to the agencies of government, sovereignty itself remains with the people, by whom and for whom all government exists and acts.” Yik Wo v. Hopkins, Sheriff, etc., 118 U.S. 356
“…at the Revolution, the sovereignty devolved on the people; and they are truly the sovereigns of the country, but they are sovereigns without subjects…with none to govern but themselves; the citizens of America are equal as fellow citizens, and as joint tenants in the sovereignty.” CHISHOLM v. GEORGIA (US) 2 Dall 419, 454, 1 L Ed 440, 455 @DALL 1793 pp471-472
“The people of this State, as the successors of its former sovereign, are entitled to all the rights which formerly belonged to the King by his prerogative. Through the medium of their Legislature they may exercise all the powers which previous to the Revolution could have been exercised either by the King alone, or by him in conjunction with his Parliament; subject only to those restrictions which have been imposed by the Constitution of this State or of the U.S.” Lansing v. Smith, 21 D. 89., 4 Wendel 9 (1829) (New York) “D.” = Decennial Digest
Lansing v. Smith, 4 Wend. 9 (N.Y.) (1829), 21 Am.Dec. 89; 10C Const. Law Sec. 298; 18 C Em.Dom. Sec. 3, 228; 37 C Nav.Wat. Sec. 219; Nuls Sec. 1`67; 48 C Wharves Sec. 3, 7.; NOTE: Am.Dec.=American Decision, Wend. = Wendell (N.Y.)
” The very meaning of ‘sovereignty’ is that the decree of the sovereign makes law.” [American Banana Co. v. United Fruit Co., 29 S.Ct. 511, 513, 213 U.S. 347, 53 L.Ed. 826, 19 Ann.Cas. 1047.]
“The state cannot diminish rights of the people.” [Hertado v. California, 100 US 516.]
The assertion of federal rights, when plainly and reasonably made, is not to be defeated under the name of local practice. [Davis v. Wechsler, 263 US 22, 24.]
“Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.” [Miranda v. Arizona, 384 US 436, 491.]
“There can be no sanction or penalty imposed upon one because of this exercise of constitutional rights.” [Sherer v. Cullen, 481 F 946.]
Discretion: The term discretion does not appear at any place in any oath of office.Yet you may hear where judges invoke judicial discretion. District Attorneys invoke “prosecutorial discretion.” There is no such thing. Like many techniques to defraud the ignorant among us, the use of these imaginary devices are criminal. Let us stress that these are crimes. Crimes against the people. These crimes are not politics…they are deliberate abuses of our Constitutional protections.
Isn’t time you got involved?
Below are several links presented for your review. Perhaps you never realized it is as bad as it is. As sovereigns, we are all bound to each other to clean up this mess. That means everyone…to what ever extent they can contribute. You have questions…? Pick up the phone and call me…714-964-4056. If I miss your call, with rare exception I will get back with you within hours. – arnie – just one of the people.
